CSPA exposes 108 improperly exempted wastewater violations in proposed settlement for Malagna County Water District, asks for additional enforcement

January 25, 2009 -- CSPA has learned that 108 improperly exempted violations were not included, mentioned or discussed in the circulated Administrative Civil Liability Complaint for Malaga County Water District WWTF in Fresno County.  To CSPA, this seems to represent an emerging trend (along with the settlement for California Dairies Inc.) in "exempting" or ignoring violations that require the imposition of Mandatory Minimum Penalties (MMPs).  CSPA believes assessment of MMPs is nondiscretionary and requests that the Regional Board initiate an additional enforcement action.
